Casa Olivia - Holiday Rental Terms and Conditions
The Property
Casa Olivia, Penna San Giovanni (MC), Le Marche, Italy.
Agreement
By paying the Booking Deposit you agree to be bound by these terms and conditions, that you are over 21 years of age, that you accept full responsibility for all payments due and for the consequences of any actions of all persons who will use the Property during your holiday, and that you will vacate the Property at the conclusion of the Rental Period.
Booking and Payment
The Booking Deposit is payable at the time of booking. The balance of the Rental Fee is payable eight weeks prior to the Rental Period, together with the Security Deposit. If the balance is not received on time we reserve the right to cancel your booking and retain the Booking Deposit. If the booking is made within the eight weeks prior to the Rental Period, the full Rental Fee is payable at the time of booking, together with the Security Deposit. The Rental Fee includes a payment for reasonable consumption of electricity, gas and water whilst at the Property. The Rental Fee does not include any payment for heating, which will be agreed and deducted from the Security Deposit. We will return the Security Deposit as soon as practicable after the Rental Period, less any deduction made in accordance with these terms and conditions.
Cancellation
If you cancel your booking at any time you will remain liable for the full balance of the Rental Fee. We will seek to re-let the Property for the Rental Period and endeavour to refund the money paid by you, less the Booking Deposit. We reserve the right to re-let at a discount or for a shorter period in which case we will pay the refund or a proportion of it if the Property is re-let for a shorter period, less the discount and the Booking Deposit. We reserve the right to retain the balance of the Rental Fee should it not be possible to re-let the property for the Rental Period. We reserve the right to cancel the booking any time in the event of circumstances beyond our reasonable control or if in our opinion it is necessary to undertake essential works at the Property. In these unlikely circumstances we will endeavour to offer a suitable alternative property. If no such alternative property is agreed between us then we will refund in full all money received by us for the booking. We will not otherwise be liable for any loss incurred by you as a result of the cancellation. We do not operate any scheme of cancellation or travel insurance and you should obtain your own insurance cover.
Occupation
You must not use the Property for any purpose other than that of a holiday. You must not sublet or underlet the Property. The number of people staying in the Property must not exceed the number stated on our website and the use of tents or sleeping in motor vehicles adjacent to the Property is not permitted. You must not use the Property for any activity or in such a way as to cause nuisance or annoyance to us, our visitors or our neighbours. You and your guests must comply with any reasonable regulations relating to the Property, or the site within which the Property is situated, which will be communicated to you on your arrival at the Property.
Your Obligations
You agree to keep the Property and all fittings, furniture equipment and other contents in or on the Property in a like state of repair and condition as at the commencement of the Rental Period and will make good (or will arrange with us to make good) any damage, breakage, or loss that may occur during the Rental Period. We reserve the right to charge you for such repairs if we consider it necessary. You agree to leave the Property in a clean and tidy condition on your departure and ensure you take all belongings with you. If the Property is left in a condition that requires cleaning over and above the normal weekly clean, this will be charged at GBP 10 per hour and deducted from the Security Deposit. You are not permitted to have pets at the property, other than with our express permission. You are not permitted to smoke, nor allow smoking at the Property. If this is not strictly adhered to it may lead to a deduction from the Security Deposit. You must allow anyone authorised by us to enter the Property during the holiday. We will endeavour to give you reasonable notice of such a visit except in an emergency when immediate access must be allowed.
Our Right to Refuse/Terminate Booking
We reserve the right to refuse any booking. We reserve the right to terminate your booking and ask you and your guests to leave immediately if we deem it necessary as a result of your behaviour or that of your guests, or any other material breach by you of these terms and conditions.
Rental Period and Arrival/Departure
The Rental Period begins at 4pm on the Saturday of arrival and ends at 10am on the Saturday of departure. We reserve the right to make a charge if your stay extends beyond this period. If your stay is for more than one week, you must vacate the Property between 10am and 2pm each Saturday whilst we do the weekly cleaning and gardening.
Description of Property
We will endeavour to inform you at the time of booking of any changes to our website description. All information is given and statements are made in good faith, and we shall not be liable for any loss or damage resulting from information given, or statements made whether orally, or in writing. We shall not be liable for any works or activity of any sort occurring on any premises neighbouring the Property.
No Tenancy
This agreement is for the purposes of a holiday rental only and does not create the relationship of Landlord and Tenant between you and us. You will not be entitled to a tenancy or to any other form of statutory security of tenure as a result of this agreement.
Complaints
If you have any cause for complaint during your holiday, please notify us and we will make all reasonable efforts to assist and resolve the issue. We will not make any refund or recompense in respect of a complaint made after departure if the complaint was not made known to us during the Rental Period.
Liability
We will not be liable for any act, neglect or default on the part of any person nor any accident, damage, loss, injury, expense or inconvenience whether to person or property which you or any other person may suffer or incur arising out of or in any way connected with the holiday rental or resulting from any other cause whatsoever. We advise you to arrange your own insurance to cover yourselves and your personal belongings whilst staying at the Property.
